These Terms of Service apply when you use KindKeeps.com or purchase a Kind Keeps product. By using the website or placing an order, you agree to these Terms.
Personalized Products
Kind Keeps allows customers to create personalized keepsakes using photographs, names, dates, messages, designs, and other customer-provided information. Customers are responsible for reviewing their keepsake before completing an order. The final product is produced based on the design and information associated with the order at the time of purchase.
Your Content
By uploading photographs, text, or other content to Kind Keeps, you confirm that you have the right to use that content for the product you are creating. You may not knowingly upload content that: • Violates another person's intellectual property rights • Violates privacy or publicity rights • Is unlawful • Contains malicious software or code • Is intended to abuse, attack, or interfere with Kind Keeps or its services You retain ownership of the content you provide. You grant Kind Keeps permission to use that content only as reasonably necessary to provide the service, create your preview, save your project, produce your keepsake, fulfill your order, provide customer support, maintain appropriate business records, and protect the integrity of the transaction.
Design Approval
Before purchasing, customers are responsible for reviewing: • Spelling • Names • Dates • Messages • Photo selection • Photo crop and positioning • Text positioning • Design selection • Other personalization choices The production version associated with the completed order is considered the approved design for fulfillment purposes.
Orders
Submitting an order does not require Kind Keeps to accept an order that is fraudulent, technically invalid, impossible to produce, unlawful, or otherwise inappropriate. If Kind Keeps is unable to fulfill an accepted order, we may cancel the order and issue an appropriate refund.
Pricing
Prices are displayed before checkout and may change for future purchases. The price applicable to a customer's order is the price shown at the time checkout is completed. Applicable shipping charges and taxes are displayed through Shopify checkout.
Production and Shipping
Most orders are expected to be prepared for shipment within 3–5 business days. Production time does not include carrier transit time. Shipping methods, charges, and delivery estimates are presented during checkout. Delivery estimates are not guaranteed.
Cancellations, Returns and Refunds
Personalized products are subject to the Kind Keeps Returns, Refunds & Cancellations Policy. Customers may request cancellation before production begins. Because products are customized for each customer, orders generally cannot be returned simply because a customer changes their mind after production begins.
Website Availability
Kind Keeps works to keep its website and services available and functioning properly, but uninterrupted or error-free access cannot be guaranteed. We may temporarily restrict or suspend parts of the service for maintenance, security, technical problems, or other operational reasons.
Limitation of Responsibility
To the extent permitted by applicable law, Kind Keeps is not responsible for indirect or consequential losses arising from use of the website or delays caused by circumstances outside our reasonable control. Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited.
Changes to These Terms
Kind Keeps may update these Terms as the service and business evolve. The version published on the website at the time an order is placed will govern that transaction unless applicable law requires otherwise.
